The 2nd U.S. Circuit Court of Appeals in New York ruled that a key part of the Defense of Marriage Act is unconstitutional. The judge ruled that the section of the law that defines the word "spouse" when referring to a man or woman's partner, cannot be limited to a member of the opposite sex, rather, it should include same sex couples as well. The issue is expected to reach the Supreme Court next year.
