Orta crossed the centerline on Ironwood Road in South Bend and struck Toner with his SUV. Investigators say Toner sat up after the crash, but Orta ran over him. Orta was reportedly intoxicated and had cocaine in his system at the time. His family plans to appeal the sentence.
